China Issues New Fatigue Driving Rules: Passenger Transport Drivers Limited to 8 Hours in 24

Gasgoo Munich- On March 30, Gasgoo learned that the Ministry of Public Security of China has officially released the Rules for Determination of Fatigued Driving of Motor Vehicle Drivers (GA/T 2372-2026). The standard is set to take effect nationwide on June 1, 2026. The new regulations mark a shift from the previous method, which relied primarily on continuous driving time, introducing instead a three-dimensional assessment system based on "driving behavior + physiological state + life trajectory."

Under the new rules, a driver will be deemed fatigued if any of the following conditions are met: driving continuously for more than 4 hours without stopping, or resting for less than 20 minutes; for passenger transport drivers, driving continuously for more than 2 hours between 10 p.m. and 6 a.m. without required rest; or accumulating more than 8 hours of driving time within a 24-hour window. The rules explicitly define passenger transport drivers as those engaged in commercial road passenger transport operations.

Addressing accident scenarios, the new rules clarify that fatigued driving can be established if a driver failed to take timely evasive action despite having the opportunity to do so, and an investigation reveals one of the following: monitoring equipment such as video surveillance or EEG devices detects the driver closing their eyes (both eyelids completely shut for more than 2 seconds) or showing brainwave values below 30 within the 10 minutes preceding the incident; questioning confirms the driver was unable to concentrate, was in a trance, or felt drowsy; or an investigation into pre-trip factors—such as sleep, work, diet, medication, and lifestyle—uncovers one or more anomalies listed in the rule's appendix.

The implementation of these rules provides a clear quantitative basis for accurately identifying fatigued driving and apportioning accident liability. It also sets stricter standards for the daily routines and driving habits of all motorists—particularly those in the passenger transport industry.
