China’s Government to Carry out Regulations on Service of Online Hailing

Gasgoo (Shanghai, July 28)—There will be a conference on which Chinese authorities may discuss about implementation of new regulations on service of online hailing this afternoon.

Look back on November 10, 2015, there was official announcement that new regulations may be launched based on soundings among people in this country. Adjustment and improvement has been made on draft of new regulations a year later.

There have been three issues causing hot discussion among people. Owners who have registered to be driver to provide service of online hailing should stop using their vehicles if they have worked for eight years or more according to some. On the contrary, some hold opinions that, working as part-time drivers, owners of private cars could be exempt from following regulations targeting at full-time drivers. Service life of private cars which may be used for providing service of online hailing should be decided by driving range. In this way, there may be more people joining to provide part-time service of online hailing.

Moreover, considering protection of their rights, people who may register to be part-time drivers should sign a contract of labor with agencies, as 30% of respondents pointed out. However, there may be only relationship of economic cooperation, rather than labor relation, between both sides, according to the rest. There could be a temporary agreement to guarantee rights of those part-time drivers, as some experts have suggested. Replacement of the contract of labor with a temporary agreement may attract more owners of private cars to provide service of online hailing.

Approval from provincial governments may be enough for development of business of online hailing, decreasing cost of administration. Agencies which have business beyond boundaries of province may not need to get approve from the local governments.

Result of discussion on these three issues remain to see after the conference.
