Provisions for Trial Implementations of Customs Entry Procedure for Automobile Spares and Parts at Specified Custom Houses

CUSTOMS GENERAL ADMINISTRATION
(Promulgated by Decree No. 23 of the Customs General Administration on July, 26, 1991)

Article 1 These Provisions are made to strengthen the customs control for imported automobile spares and parts with a view to promoting production and legitimate business operations.

Article 2 The consignee or his proxy engaged in importing automobile spares and parts should perform the procedures of requesting the port of entry, applying for an import license, and paying customs duties at the following specified customs offices:

(1) Main offices of the 16 customs at Beijing, Dalian, Nanjing, Huangpu, Zhanjiang, Haikou, Nanning, Xiamen, Wuhan, Kunming, Chongqing, Harbin, Changchun, Shenyang, Manzhouli and Erlian;

(2) Xingang Customs of Tianjin, Wenjindu Customs of Shenzhen, Wharf Office of Qingdao Customs, Pujiang Customs and Wusong Customs of Shanghai, Xinfeng Office of Guangzhou Customs and Mawei Customs of Fuzhou.

Article 3 Except declaration of and payment of duties on imported automobile spares and parts are performed at the customs offices specified in the second paragraph of Article 2, the spares and parts concerned are not allowed to be transhipped to another port of entry and customs office for declaration and payment of duties.

Article 4 In making declaration to the customs on the entry of automobile spares and parts, the consignee or his proxy must submit for examination the invoices and contracts concerned containing detailed descriptions of names, serial numbers, specifications, types quality grading, car models, countries of origin and producers of the spares and parts. If no such detailed descriptions are given, the customs has the right to refuse acceptance of the entry declarations concerned.

Article 5 Foreign-funded enterprises, when import automobile spares and parts for production or private use according to the fiscal plan upon approval but find difficulties to perform declaration of entry and payment of duties at the ports specified in Article 2, must apply for permission from the customs in charge for shipment of the spares and parts to another port of reasonable direction to complete declaration of entry and payment of duties in the related customs office. The customs in charge is responsible for referring the matter to the customs involved.

Article 6 For imports of key parts of automobiles by import licenses obtained before the enforcement of these Provisions, or for imports of automobile spares and parts by contracts signed before the enforcement of these Provisions at ports other than those specified, the terms of the licenses or contracts concerned shall be valid until the end of 1991.

Article 7 These Provisions shall come into force as of August 1, 1991.
